These Terms explain the rules that apply when you visit our website, use our online services or buy from SIMI Jewelry. Please read them carefully before using the store.

Overview

Welcome to SIMI Jewelry. The terms "we", "us" and "our" refer to SIMI Jewelry. We operate this store and website, including the information, content, features, tools, products and services made available through them, together called the Services. Our store is powered by Shopify, which provides the ecommerce platform we use.

These Terms of Service, together with the policies referred to in them, explain your rights and responsibilities when you use the Services. They include important provisions about orders, warranties, liability and the permitted use of our website.

By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Access and account

By agreeing to these Terms, you confirm that you are at least the age of majority where you live. You also consent to any minor dependants using the Services on devices that you own, purchase or manage.

To browse the store or place an order, you may be asked for information such as your email address and billing, payment and delivery details. You confirm that the information you provide is accurate, current and complete, and that you are entitled to provide it.

You are responsible for keeping your account credentials secure and for activity carried out through your account. You may not transfer, sell, assign or license your account to another person.

Our products

We take reasonable care to describe and display our products accurately. Colours and appearance can vary between screens because of device settings and display technology.

Product descriptions may be updated without notice. We may discontinue a product or limit the quantity available to a person, region or jurisdiction, subject to applicable law.

Nothing in this section limits your right to receive goods that match their description, are of good quality, are safe and are fit for their intended purpose under South African consumer law.

Orders

Placing an order is an offer to purchase. We may accept or decline an order, subject to applicable law. Your order is accepted only when we confirm acceptance and successfully process payment.

Please review your order before submitting it. We may be unable to cancel or change an order after it has been accepted or dispatched. If we decline, change or cancel an order, we will try to contact you using the email address, billing address or phone number supplied with the order.

Voluntary returns and exchanges are handled under our Refund and Returns Policy. Your statutory remedies remain separate. If applicable law requires a monetary refund, we will not substitute store credit unless you choose store credit. Delivery is handled under our Shipping and Delivery Policy.

You confirm that purchases are for personal or household use and not for unauthorised commercial resale or export.

Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when your order is placed and will appear in your order confirmation.

Prices displayed on our website include VAT at 15%. Shipping is charged separately unless the order qualifies for free delivery. International customers are responsible for any customs duties, import taxes or similar charges imposed by the destination country.

Promotions may have separate terms. If promotion terms conflict with these Terms, the promotion terms apply to that promotion.

You agree to provide accurate and current purchase, payment and account information and to update it when necessary. You confirm that you are authorised to use the payment method supplied and that the payment provider will honour the charges.

Shipping and delivery

Delivery times are estimates and can be affected by couriers, customs, public holidays and events outside our reasonable control. We will keep you informed and assist where a parcel is delayed or missing, as explained in our Shipping and Delivery Policy.

Goods remain at our risk until you, or a person you authorise, accept delivery. Nothing in these Terms limits the delivery rights available to you under the Consumer Protection Act or other applicable law.

Where applicable law requires a defective item to be returned at our expense, we will arrange collection or provide an appropriate prepaid return method.

Intellectual property

The Services and their content, including our trade marks, branding, text, displays, images, graphics, reviews, video, audio and design, are owned by SIMI Jewelry, our affiliates or our licensors and are protected by South African and applicable international intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material from the Services, except where the law expressly permits it.

These Terms do not grant you a licence to any intellectual property belonging to SIMI Jewelry, Shopify or a third party. SIMI Jewelry names, logos, product names, designs and slogans may not be used without prior written permission. Shopify names and marks belong to Shopify. Other marks belong to their respective owners.

Optional tools

We may provide access to tools supplied by third parties. We do not necessarily monitor or control those tools.

Third-party tools are provided on an "as is" and "as available" basis, without endorsement or a separate warranty from us. Your use of them is at your discretion and may be subject to the third party's own terms.

New features, tools and resources added to the Services will also be subject to these Terms.

Third-party links

The Services may include content, functionality or references provided by third parties. We are not responsible for the content or accuracy of third-party services you choose to access.

If you leave our Services to use a third-party service, you do so at your own discretion. Review the third party's terms and privacy practices before completing a transaction. Questions about third-party products or services should be directed to that third party.

Relationship with Shopify

SIMI Jewelry is powered by Shopify, which enables us to provide the Services. Sales made through our store are made directly between you and SIMI Jewelry.

Shopify is not the seller of our products and is not responsible for the sales contract between you and SIMI Jewelry, including injury, damage or loss resulting from products purchased from us. To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from your purchases and transactions with SIMI Jewelry.

Privacy policy

Personal information collected through the Services is handled under our Privacy Policy. Certain information may also be subject to Shopify's privacy terms. By using the Services, you acknowledge that these privacy terms apply.

Because Shopify hosts the Services, Shopify processes information about your access to and use of the store to provide and improve its services. Information may be shared with Shopify and service providers in other countries where necessary to operate the Services. Our Privacy Policy explains how SIMI Jewelry, Shopify and our service providers use personal information.

Feedback

If you submit ideas, suggestions, reviews, proposals or other content, together called Feedback, you grant us a perpetual, worldwide, sublicensable and royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback for purposes connected with operating, improving and promoting the Services.

You confirm that you own or have the rights needed to submit the Feedback, have disclosed any compensation or incentive connected with it, and that it complies with these Terms.

Unless required by law, we do not have to keep Feedback confidential, pay for it or respond to it. We may monitor, edit or remove Feedback that we reasonably consider unlawful, offensive, defamatory, obscene, misleading or in breach of another person's rights or these Terms.

Feedback must not violate intellectual property, privacy or other rights, contain unlawful or abusive material, contain malware, use a false identity or mislead us about its source. You are responsible for the Feedback you submit and its accuracy.

Errors, inaccuracies and omissions

Information in the Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, transit times or availability.

Subject to applicable law, we may correct errors, update information or cancel an affected order. If an accepted order is cancelled because of our error, we will refund the amount paid.

Prohibited uses

You may use the Services only for lawful purposes. You may not use them, directly or indirectly:

For unlawful, fraudulent or malicious purposes, or to violate any applicable law.
To infringe our rights or the rights of another person.
To harass, abuse, threaten, defame, intimidate or harm another person.
To transmit false or misleading information, spam or unsolicited promotions.
To impersonate another person or misrepresent the origin of content or communications.
To interfere with another person's use of the Services or expose SIMI Jewelry, Shopify or users to harm or liability.

You also agree not to upload malware; copy, extract, sell or exploit any part of the Services; collect personal information unlawfully; phish or pretext; use automated scraping or data extraction tools without permission; or bypass security, authorisation or robot exclusion measures.

We may suspend or terminate access if we reasonably determine that you have violated these Terms.

Agents

This section applies if you use, allow or deploy an Agent to interact with the Services. An Agent is software or a service that acts autonomously or semi-autonomously for a person or organisation, including software operating on a person's device without direct supervision.

An Agent may interact with the Services only if it identifies itself and follows these requirements. An Agent must:

Identify each HTTP or HTTPS request as coming from an Agent and disclose its name in the user agent string in the format "Agent/[agent name]".
Not hide or disguise automated access, mimic human behaviour to avoid detection, or complete or bypass CAPTCHAs.
Answer truthfully when asked whether an interaction comes from a person or a computer.
Not bypass measures intended to block, limit or control automated access.
Stop interacting with the Services if we request that it do so.

We may use technical measures to limit whether and how Agents access or interact with the Services.

Termination

Subject to applicable law, we may terminate these Terms or suspend your access to all or part of the Services where reasonably necessary, including for a breach of these Terms. You remain responsible for amounts due up to the date of termination.

Provisions that by their nature should continue after termination will survive, including provisions relating to intellectual property, Feedback, warranties, liability, indemnification, severability, governing law and privacy.

Disclaimer of warranties

Information presented through the Services is provided for general information. While we take reasonable care, we do not promise that all information will always be complete, current or free from error.

To the fullest extent permitted by law, and except for warranties expressly given by SIMI Jewelry, the Services are provided on an "as is" and "as available" basis. We do not guarantee that the website will always be uninterrupted, timely, secure or error-free.

Nothing in these Terms excludes or limits any warranty, guarantee or consumer right that cannot lawfully be excluded, including rights under the Consumer Protection Act.

Limitation of liability

To the fullest extent permitted by law, SIMI Jewelry and our partners, directors, employees, affiliates, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential loss arising from your use of the Services or products purchased through them. This includes loss of profit, revenue, savings or data where the law permits those losses to be excluded.

These limitations do not apply to liability that cannot legally be excluded or limited, and do not reduce your rights under the Consumer Protection Act or other applicable law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless SIMI Jewelry, Shopify and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against third-party claims and reasonable legal costs arising from:

Your material breach of these Terms or a policy incorporated into them.
Your unlawful conduct or violation of another person's rights.
Your misuse of the Services.

We will give reasonable notice of a claim. You agree to cooperate with the defence. We will not agree to a settlement that imposes a non-monetary obligation on you without your reasonable consent.

Severability

If a provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest lawful extent or severed where necessary. The remaining provisions will continue to apply.

Waiver and entire agreement

If we do not enforce a right or provision immediately, that does not mean we waive it.

These Terms and the policies or operating rules published for the Services form the entire agreement between you and SIMI Jewelry about your use of the Services. They replace earlier agreements, communications and proposals on the same subject.

Assignment

You may not transfer or assign these Terms, or your rights or obligations under them, without our prior written consent. Subject to applicable law, we may transfer or assign our rights and obligations as part of a sale, restructuring or transfer of the business or Services.

Governing law

These Terms and any separate agreement under which we provide the Services are governed by the laws of the Republic of South Africa.

Disputes are subject to the jurisdiction of the South African courts. Nothing in this section limits a consumer's right to approach the National Consumer Commission, a consumer tribunal, an ombud or another body available under applicable law.

Changes to these Terms

You can review the current version of these Terms on this page at any time.

We may update these Terms by publishing a revised version on our website. Where required by law, we will give notice of material changes and state when they take effect. Continued use of the Services after the effective date means you accept the revised Terms.
